“A news reported by BBC – A leading Egyptian scholar has demanded that people caught importing a female virginity-faking device into the country should face the death penalty. Abdul Mouti Bayoumi said supplying the item was akin to spreading vice in society, a crime punishable by death in Islamic Sharia law. The device is said to release liquid imitating blood, allowing a female to feign virginity on her wedding night. There is a stigma about pre-marital sex in some conservative Arab societies.The contraption is seen as a cheap and simple alternative to hymen repair surgery, which is carried out in secret by some clinics in the Middle East. It is produced in China and has already become available in other parts of the Arab world.The device is reported to be on sale in Syria for $15. Professor Bayoumi, a scholar at the prestigious al-Azhar University, said it undermined the moral deterrent of fornication, which he described as a crime and one of the cardinal sins in Islam.Members of parliament in Egypt have also called for banning import of the item.”
It is very important to understand certain terms used in todays Islamic terminology.One of such is SHA’RIAH.The term Shi’rah (plural –Sha’riah) literally signifies , “the way to a watering place from which men and animals derive the element indispensible to their life.”As a term in the Qur’an it is referrred to the laws framed by Allah(The God) to establish a peaceful and honourable co-existence in the human world wherein every individual’s rights are protected and the laws have been framed in the Qur’an in details.These laws in no way are against any of the fundamental rights of an individual rather these laws are so beautiful that they arte the source of peace in the society.
But, more than 250(appx) yrs after the sad demise of the Prophet of Islam-Muhammad(may peace be upon him) some unscrupulous intellectuals such as Imam Hanifa, Imam Muslim, Imam Shafai and Imam Hanbal constituted books of laws for the Muslim World and named them Sha’riah .They wrote these books individually and have given conflicting judgements on particular issues at many instances which may be separately discussed in coming days.
That is to say that they were having varied opinions on the same subject.They devised the laws from their understanding of the Qur’an and the Books of Hadees available.What are these books of Hadees? These are trash literatures containing concocted stories about the Prophet of Islam, Muhammad (may peace be upon him) developed again after almost 200 to 250yrs after his death by another 6 unscrupulous intellectuals of that time, their names are thus—Imam Bukhari , Imam Muslim, Ibn Majei, Abu Dawood, Tirmizi, Ibn Nisaayee. All these Imams belong to the same period in History.A critical exmination of these books suggest logically that these are trash in nature and has got no value and truth and is contradictory within itself and is in strong contradiction with the Qur’an.
An excerpt from the Qur’an ( 5:48) reads—“………unto everyone of you have WE appointed a law and a way of life.and if Allah so willed He could surely have made you all one single community: but —in order to test you by means of what He has vouchsafed unto you.Vie , then, with one another in doing good works—–unto Allah you all must return—and then He will make you truly understand all that on which you were wont to differ”
Now , it is always true that any act that comprises fraud and deception is unethical and deserves resistance. It must be forbidden and taken seriously.All measures must be taken both by the Government and by the intellectuals to stop it.And the clerics and the scholars have the right to declare it unethical and unjust and must protest to the ultimate.BUT TO DECLARE IT AN OFFENCE PUNISHABLE TO DEATH UNDER THE ISLAMIC LAW IS WRONG as Islam doesnot teach or direct to such a punishment rather it wants a correction in the thinking mechanism, Islam aims at killing the crime not the criminals and aims at removing the criminal intelligence and replace it with the knowledge of truth and justice.Islam aims not at punishments but at rectification of errors.
In Qur’an the punishments mentioned in certain instances are very nominal compared to the weight of the crime.The rectification and character building has been targeted. It aims at conversion of evil minds into riteous ones by developing an atmosphere of teaching of Quran and God-consciousness. Our clerics are failing in their job of developing God consciousness and is lost in the world of Fatwas( religious opinions), there is left no room for compassion. Laws are made very stringent and there exists no system of forgiving. In strict and blindly applying the yardstick of justice, no human consideration is involved and, therefore, the behaviour of the individual or the society tends to become harsh .
The Qur’an therefore enjoins the dispension of justice with definite inclination towards kindness. This is what is missing today.
Thus , I appeal to the scholars and every individual of the Muslim World to come forward and to take endeavors to convert criminals to good people. To use the intellectual brains for the purpose of human welfare and propagate their interests and knowledge for human welfare and continuously strive this way against the conspiracy of Satan.
